Debt Collectors etc

    Hi

    I lost my job in feb and done all the right things like go to mabs etc. On the list with them was the Credit Union I was under the impression that it was been paid any way... I openen my front door today and there was a man from the Credit Union on my front door step to my shock it wasn been paid prob an over sight by Mabs I was given no warning that The Credit Union were now sending people put to find out information regarding why the money was not been paid. IM so confussed is this against the law or should Ive been informed that this might happen the man was nice enough and been the actress that I am I brushed it of but now I sit here shocked that this could happen I feel really embarssed at this. I felt that I had to explain myself to a total stranger at my own front door SOS any thoughts on this

    You could have kept insisting that must be the chinese delivery man from when you ordered twenty mins ago and continue to laugh heartily when he mentions the credit union.. He would have left eventually..

    1. Sorry to hear your in this situation.
    2. Get down to them as soon as possible and start chatting to them.
    3. Keep up even small regular payments. They don't really want to go to court so as long as your seriously making attempts at regular payments of some kind, they will come to some negotiated altered payback plan with you.

    If he was from the credit union themselves its probably ok but if he was from a private debt collection company i would be raising questions with the credit union about what details where passed on and were there any breaches of the Data protection act. I have to ask OP though surely you were contacted in some other way before this.

    Do you open your post? I'm pretty sure the CU wouldn't go to the time and expense of sending out a man to strongarm you, without sending you at least one letter first.

    AFAIK baliffs have no rights to enter your house/take property, so don't let them in.

    Get down to the CU ASAP and sort out some kind of payment plan with them.

    OP, are you not monitoring your finances? If things are bad, you should be monitoring your finances daily. Thats a big oversight. Even though you passed the matter to MABS you should still be monitoring your finances! Change that pronto dude!

    Its not illegal for door to door collections but there is legislation about when they can call etc. Get onto your CU asap and come to an arrangement with them about repayment. Make some effort to pay what you can. Get the agreement in writing.

    Sorry to hear about your job. If I had a loan or debt, I would certainly remember if I had paid it off. You must have gotten several notices from the CU before they sent someone around, no? Sit down with the CU and talk it out.

    I object, not 100% accurate.
    Although not the first place best to post, its the most frequented and that why some do so here.
    There are some very decent people here too and are only too willing to give genuine answers! :)

    (That said, half the time, I'm usually a plonker - the other half ...a sex crazed lunatic.)

    Even if this is a wind up (for a first post it would be pretty good), there are thousands of people caught in a similar situation who would be very offended by some of the comments posted here.

    They negotiate with financial institutions on behalf of people too.

    OP. Having spent sometime working with MABS , this is how it works.

    MABS provides you with advice and expertise in dealing with your creditors.

    They will also help you in setting up a budget and negotiate regular payments wth your creditors. They do not provide loans or money , all they will do is set-up an account for you to pay money into , this money will then be distributed to your creditors are per the agreements set out initially with your creditors as negotiated by MABS.

    They will also assist you with your budget planning , a service they provide to anyone including people who are not struggling with debt but find it hard to manage the household budget.

    Once this money is being paid regularly and on time , the creditors will normally leave you alone until an agreed reveiw date. At this time they will reveiw your circumstances and change or continue your repayments.

    Now a problem did exsist and this maybe where your issue may lay, if the credit union you owe is also the credit union that you have set -up another account for the money to be distributed by MABS , then it needs to be made clear to the credit union that this account is for the purpose of facilitating payments to your creditors through MABS. The credit union will see one account with money actively entering and leaving while the other is slipping further into the red. There was an issue a few years back where some CU's would not talk with MABS as they are generally community based and preferred to deal directly with their customers.
    It would seem to me that you have ignored contact from the CU and that is why they have sent a representative to your home. He would firstly be looking to see if you were still resident at the address and to get an understanding of your situation.

    My advice to you is to speak again with MABS and then approach the CU with a breakdown of your income and outgoings and an offer of repayments you can afford. Never offer more than you can afford and never let them bully you into a repayment schedule that will cause you hardship.

    Dealing directly with people will get you peace of mind and will also stop visits to your house. Remember you can only give what you can afford.

    Take these steps tomorrow and by next week you will be in a happier place. Remember the economy is gone to hell in a handbasket so these institutions are delaing with people everyday in similar or worse situations than yourself.

    Best of luck with it all. It will turn out fine. Just be upfront with people and explain your case.
