Summons

I got pulled over for speeding back in April. My NCT had expired and I had my test date for about 2 weeks afterwards. I told the guard this and he was fie with it. He told me to produce my Insurance disk at the local garda startion within 10 days and then my NCT cert when I had it. I produced my insurance cert as directed.

I then put my car through the NCT but it failed. I got the things fixed and applied for another day, which is not till August. Today I got 4 summons in the post!
    • Failure to Produce NCT Certificate
    • Using Vehicle without NCT Certificate
    • Failure to Produce Insurance Certificate
    • No Insurance

The last one is obviously wrong, my tax and insurance were perfectly in date. The only thing is that I think I might have been a couple of days late when I produced my insurance cert at the station, but Garda processing it did not say anything to me anyway.

Court date is 23rd September I'll have no problem getting my car NCT'd by then. My question is can I get all this sorted before the court date or do I have to show up? Incident happened when on holidays and is all the way down in Kerry!

    Any advice appreciated.
    Thanks

You have to appear in court.

If you fail to appear the judge will issue a warrant for your arrest.

Bring proof of what you mentioned above with you, including the letter from the NCT Centre re. the test date, your insurance and tax discs for the time you were stopped etc.

Judge will most likely throw it out. But you will still have to go there.

Lesson: Avoid Kerry (their horses have to wear nappies you know). :D

No NCT in April, and still no valid NCT now.

That doesn't look great tbh. Get the car in pronto, and make sure it passes this time!

I'd get an earlier cancellation for the NCT, just in case you end up waiting on parts or something. Other than that all you can do is show up in court with a valid NCT and hope for the best.

You must show up in court. Bring your Insurance cert and tax disc with you. This will prove you were insured & taxed. Bring all the NCT appointment letters with you. If you fix the problems wrong with the car, bring the garage reciept proving you fixed it. If you fixed it yourself, bring the reciepts for the parts you had to buy. This shows you're not a careless driver who couldn't give a ****.

Book another NCT date and ring everyday for cancellations, check their website. 9 am - 11 is the best times to ring. If you have to travel further for it then do it. If you can have the car back on the road legally it'll be in your favour.

Judge might dismiss the Insurance part but he doesn't have to as you said you produced late. But if you bring your cert proving you were insured you should get off it. If the car has NCT he might strike the whole case out.

Did you recieve any penalty points?

Afaik even if you got points, they can only give you points for 1 of the listed offences. However they could fine you for each listed offence. Unlikely to happen but just to keep an open mind. Someone please correct me if I'm wrong. I'm going on other things I have read on boards.

Get it nct'd asap. Bring it to court with your cert of insurance and your driving licence. While you are liable to the non production the fines are small.

You didnt get a summons for No NCT. Its the No NCT summons that carries the 5 points;) Mary O Halloran is the judge in North Kerry and is a fair woman.

This only applies for fixed charge penalty notices.....not summons. NCT is a reoccurring offence ie happened before and after the Garda stopped him. Speeding two points....NCT (if he had got the summons) is 5 points.
