Issue with neighbour and satellite

    I put up a free to air dish on my chimney, it is not a shared chimney. The dish is pointing toward my neighbours house and the arm that holds the lnb is sticking out over her roof. She wants me to take it down. Where do i stand with regard to this? It does not touch her property at all.

    Structurally, Sat dishes are unsafe on chimneys. It could cause roof damage on their side if/when your chimney comes down [very strong wind for example]

    Surely you can do what you like(as long as its not immediatly dangerous), once is not on her property?

    I'm no legal expert but even I know you can't do what you like with your property. For a start there are planning permission laws to adhere to.

    On a very simple search in the Satellite forum, I found this. But I'm sure there are many.

    Does your home insurance cover dishes mounted on Chimney? You really shouldn't bolt or drill anything into the chimney structure.

    Thanks for the replys.
    I did use a lashing kit so it should be safe where it is. I put it on the chimney as it was the only place i could get signal as the house is north to south facing. As the dish needs to face east it could not be positioned on the front or rear of the house.
    With regard to planning permission you dont need any for a dish less than 1.9m in diametre. I did do some research before i posted but could not find anything with regard to dishes positioned on a chimney where it overhangs but does not touch a neighbours roof.

    Interesting you mention that, have you a link? Every site I've found states you do, and especially on a chimney because that's higher than the roof:

    A satellite dish (up to one metre across the below the top of the roof) at the back or side of the house (a dish on the front needs planning permission). Only one dish may be erected on a house.
    The citizens information site is a guideline, but it references this regulation: SI 600/2001
    (b) The erection on or within the curtilage of a house, of a dish type antenna used for the receiving and transmitting of signals from satellites.
    1. Not more than one such antenna shall be erected on, or within the curtilage of a house.
    2. The diameter of any such antenna shall not exceed 1 metre.
    3. No such antenna shall be erected on, or forward of, the front wall of the house.
    4. No such antenna shall be erected on the front roof slope of the house or higher than the highest part of the roof of the house.
    Finally, Cork city's Director of Services and Engineer similarily says

    The erection of a satellite dish on a house is classed as exempted development (i.e. does not require planning permission), subject to the following conditions:
    • Only one dish may be erected on or within the curtilage of the house (i.e. the area of land attached to the house) without planning permission.
    The diameter of the dish shall not exceed 1 metre.
    • The dish may not be erected on the front of the house or forward of the house (see diagram).
    • The dish may not be erected on the front roof slope of the house or higher than the highest part of the roof of the house (see diagram).
    On the overhanging question, I believe you are not entitled to allow anything overhang a boundary line without the other property owner's consent. You're not permitted to allow a building overhang a boundary and a neighbour is permitted to cut an overhanging branch (so long as they return it to you and not make the tree dangerous). I suspect the same principle applies.

    Agree with Slimmjc re Regs - that sat receiver needs planning permisson.

    Unless it is an apartment block, your neighbour owns the airspace over her house.

    You are not entitled to intrude on it without her permission.

    Apart from this technical trespass there is a danger that in a high wind, the aerial might bring down the chimney.
