If you are arrested and you are not convicted does it stay on your record?

    Long story short, I was arrested in error after defending myself from a scumbag who attacked me after a night out, I ended up summonsed but the garda never bothered to schedule the case so it never happened.

    I was wondering if the arrest itself will remain on some record, and if so, can I appeal to have it removed?

    The arrest will be on record. As you was not convicted it really is of no consequence for Garda vetting etc.

    I am emigrating soon and one of the questions is about arrests, its very frustrating that I have to answer yes because of this.

    On this same topic, I was advised to have a garda cert for my embassy interview for the US, in addition any other information I can provide.

    Can I just walk into the station and get a cert, and what else could they want, witness statements?

    This incident was well over a year ago and its still screwing me over, can I have the record expunged in any way?

    You have to send off to Garda HQ for the cert.

    Usually visas ask about arrest for an offence of moral turpitude. Don't thing your little spat would fall under this.

    Go to your local station with your passport and a letter stating you need a cert of character for a visa application. The Garda will get your details & process the application, usually takes two weeks.

    The ML10 is for identification of people without picture ID. There's no number on the character cert form & sometimes they are not used, so bring a letter outlining why you want the cert down with you. Certs are only issued for visa purposes, not for employment/study vetting.
