How long to settle a case?

    I have a case pending 4 years now and was wondering is this the norm?
    The case just seems to be getting nowhere, and when I ask my solicitor hes very brief with the details.

    The case was released from PIAB as the future prognosis of the injury was outside PIABs remit. This is no longer an issue though as the future implications have been known for years.

    But im getting impatient now and want this sorted out so i can move on. I want to emigrate and would rather have everything tied up before i went, as well as some money for a new life etc.

    Generally speaking, at 4 years with no signs yet of this being resolved, would this be the norm?

    What is your solicitor saying? I've seen personal injury cases settle or go to trial 10 years post accident. Not the norm but 4 years is not excessive.

    wow my case is draggin since jan 2009 and like urself i wanna move on i booked my flights 4 to go to canada and have constanly told my solister dat i had plans u shud ring the piab board directly they are very helpful im leavin the country on the 14th of aug and when i rang my solister today he had an appointment 4me 4 tuesday morning id say keep after ur soliser as they jus drag these cases on so they have their fees building up and say that the longer it goes on the more u get but i think that id say ring piab and found out how far the case is and dump ur solister and found a new 1

    Acquired brain injury cases take a long time to settle.

    Drkpower, that is a little unkind on that poster, but (s)he should realise that using mobile phone text is annoying.

    To the two injured parties

    1. Solicitors have no interest in dragging out cases. Size of the settlement rather than length case goes on is more relevant to their fee.

    2. Usual delays for cases are

    (1) waiting for final medical reports. If some of your recent medical reports have comments " impossible to give a definite prognosis at this stage" "further investigations / tests / treatment recommended" "review in six months" your legal team would be reluctant to finalise your case until there is a more definite medical report.

    (2) Altho the situation has improved in recent times, there are some delays in processing a case through the courts which are beyond your solicitor's control.

    How long your claim is in with PIAB has absolutely nothing to do with your Solicitor. PIAB have a certain period of time within which to assess a claim and take as much of this time as they want. There is absolutely nothing your Solicitor can do to quicken the process.
