Welfare Fraud Punishment?

    Hi Lads,

    I've a quick question. And before everyone assumes its in relation to me its not. (I would never be this stupid!)

    I know this guy who has been on full welfare and rent allowance etc. But they also have an unregistered business set up and even offices rented in the city centre, as well as a website! All income is cash in hand so the company pays no tax.
    The guy is being investigated by the welfare dept. now. I'm curious, whats the punishment likely to be? Jail? A big fine? Pay back the money they got? or will it be a case of "Don't do that again. No more free money for you!".

    Problem in this case is that technically he is defrauding more than one department:
    1. He's claiming welfare and SWA while working - will almost certainly be forced to pay this back over time
    2. Actually running the unregistered and presumably non tax compliant business may be the more serious problem, unless he is only employing himself. If he has employees he'll be liable for not paying deducting tax and PRSI and he'll be liable for unpaid tax and VAT, there are severe interest penalties for this

    Depending on the scale and length of time running, your imaginary friend might find himself with a quite serious fraud charge on his hands.

    Is there anything else gymsey like are they getting rent off anyone and not declaring that either?
