Neighbour removing boundary wall.

    My neighbour has been hacking away at our boundary wall as he wants to remove it and build on boundary. I have refused permission and hence I think he wants to remove wall and build on his site while wall is down. Everytime my back is turned he is hacking on both sides of the wall. It is a period property and an old mortar wall so it is not too difficult, although the wall was perfectly sound to begin with.

    I have sent him a solicitors letter and told him to desist but he is over time undermining wall. He refused to give me his building plans and now says he is not building but wants to replace wall. I believe his plan is to cause wall to fall and building his extension while it is down right up to boundary. Any advice?

    Take plenty of photographs of the damage caused, they will help for reference purposes as well. Get an Structural Engineer in to do a report on the entire wall, this will also help for reference purposes.

    I'm afraid this is a legal issue and unless anyone else can add something further from a Construction or Planning point of view, there is little else we can do here.

    All I can add to this is if protected structure, "period property", contact the LA asap and Conservation and enforcement section. No works allowed to a protected structure or lands within it's curtilage, usually, unless permission is obtained...

    If it's not a protected structure, I'm afraid the local authority will not want to know about it. Boundary wall issues are a civil matter between two parties.

    Just to say that boundary walls are mutually exclusive - basically the entire wall is owned by both parties, so one party cannot remove a section of the boundary wall (even on their side of the wall) without the others consent.

    You really have to take the advice of your solicitor on this one.
