return it to the shop for a new one anto

if its only a few months they shud swap it straight away

it's in warranty return it to Sony, they'll fix it and you'll keep the the stuff on the HDD
or return it to the shop it's faster and maybe better in term of comeback if something happens rather than a repaired console.

Sony will just tell him to return it to the store anyway. They don't do any data recovery or data return, they just swap out the consoles, but considering its only a few months, they'll tell him to go back to the store. They're quite hands-off when they know the store has to replace it.

No he'll have to ring Sony and they'll give him a reference number and he takes that to the shop where he bought it and then the shop orders a refurb. No new consoles though

So you only get the choice or repair or replace when your paying out of warranty.

He should just go to the shop straight with the receipt then and get a new one.

got one of the new 120gig slims, 2103 model number

had it for 6 days, every day i played battlefield for an hour or so and it crashed, so i sed im not having this, returned it for another one

ive had this new one for a week now, have had one crash alright, but im thinking there is a freezing/crashing problem with bf2, when you are in a tank and drive it into a certain thing or place

  • Registered Users, Registered Users 2 Posts: 1,355 ✭✭✭antocann

It is the law that you must get your money back or a replacement from the store. The law is The Sale of Goods & Supply of Services Act 1980.
Under the Sale of Goods and Supply of Services Act 1980, anything you buy from a retailer must be:

    · of merchantable quality
    · fit for its normal purpose, and reasonably durable
    · as described, whether the description is part of the advertising or wrapping, on a label, or something said by the salesperson.

When you buy goods from a retailer, you make a contract with him. He agrees to provide certain goods to you for a certain price. If your purchase turns out to be faulty, the retailer, not the manufacturer, is responsible to you and must sort out your complaint. You are entitled to a refund or a replacement.

Also, since 2002 it has become a legal requirement that all consumer goods sold in the EU must have a minimum of a 2 year warranty.

So, if something breaks within 2 years and the retailer claims that there is only a 1 year warranty, you just need to quote Article 5 of the EU Product Warranty Directive (1999):

    Article 5

    Time limits

The seller shall be held liable under Article 3 where the lack of conformity becomes apparent within two years as from delivery of the goods. If, under national legislation, the rights laid down in Article 3(2) are subject to a limitation period, that period shall not expire within a period of two years from the time of delivery.

Ya but Sony are providing the warranty not the retailer. Sony will give him a refurb. That's how they do things. I'm pretty sure though if you hassled them and pushed for a brand new one you might be able to get one but I wouldn't hold my breath

They are obliged (if he bought in March) to give him a replacement. There's no refurb only policy or Sony-only warranty, I'm not sure where you heard this, but its just plain wrong.

My PS3 died last year about 6 months after I bought it in HMV Dundrum . Rang Sony and got my replacement code (after they went through some over-the-phone fix it possibilities) and they told me to bring back my PS3 to HMV with my receipt and reference number.

Brought my 80GB fat PS3 into HMV in box with controllers/cables etc, who gave me a 120GB slim model as the fat model was discontinued. They gave me that model as the model I purchased was €399 and the 120GB was the same price, hence thats the model I got. All shops are obliged to give you an equivalent replacement

You have a warranty with the shop as well as Sony. What you're saying implies that no shop has a warranty with you as the goods all come from a supplier. Both have a warranty with the OP. Also, you are entitled to a new model, not just your model fixed.

OP, ring sony who will try to fix it over the phone, they'll give you a reference code to return to the point of sale with your receipt.
Box up your PS3, return to the shop and be nice but firm with them. You only bought the machine 4 months ago, they are obliged to replace it with the code Sony give you.

Some retailers will just give you the console, others (like HMV) will just give you a brand new box with all the bells and whistles.

I've worked in gameshops and seen it happen so my information is pretty accurate. Not sure if different shops have different policies though so I can only speak from what I've experienced.

If it were me though I wouldn't be happy with anything else other than a spanky new console
