Interst payments on delayed Social Welfare

    Obviously this is hypothetical and only of academic interest where I want to have a discussion on various Legal aspects.

    The majority of unemployed people have had to wait for a number of weeks for the Dept. of Social welfare to process their legitmate claim for Jobseekers Benefit or Allowance. In some case people have had to wait up to 16 weeks.

    If anybody makes a late payment to the Revenue Commissioners or indeed any state body they will be charged interest or penalised in some way.

    Is there any legal avenue whereby the Dept. of Social Welfare could be pursued for interest on Jobseekers Benefit claims that have been delayed by the said Depts. inefficiency aand incompetence. People who have had to wait longer have been geographically discriminated against and are at a financial loss especially if they have had to fund themselves through other means such as overdrafts, loans etc

    The simple answer is no.

    A person can apply to the Community Welfare Officer (CWO) at their local health centre who will pay a person their entitlements as supplementary welfare allowance (SWA) while the Department processes the application. If a person chooses not to apply for SWA that is their problem.
