    HI, if a vehicle is in my name but not in my posession, is it stolen?

    If it was sold or passed on with your permission then it is not stolen. If the van is still in your name it's your own fault as it's up to you to send off the log book. If you know who you sold it to you can do a change of ownership form, if you don't you'll have to contact the Dept of Environment & ask them what to do.

    Technically you've committed an offence by not filling in the new owner's details.

    That all depends on the question of whether the person who does have it has your permission to have it or not. If they have your permission, oviously its not stolen. If they don't, the issue gets a lot more complicated..The vehicle would be considered stolen in the eyes of the law anyway.
