Paid money by mistake

I started a door to door sales job a few weeks ago. The wage was 200 per week plus commission. I didnt sell anything and quit the job after one week. I got paid for that first week. Today i checked my bank account and they have paid me for a second weeks work.

They know i quit as it was my boss who suggested that it wasnt working out and we both decided it wasnt for me. They arranged for me to give back the my fuel card and stuff too.

Do i have to give back this money? I didnt ask for it or anything!
Could they do anything if i didnt give it back?
As its now in my bank account they cant take it without my permission?

Any help would be great, bit hard up for cash at the moment and id love to keep it.

Yes, you have to pay it back. It's not your money.

Was thinking that alright. If they dont ask for it back though what happens then?

somebody made a mistake, return the money. Any other action is similar to stealing imo.

If they dont contact me to ask for it back then its not really stealing though is it?
It could be treated as a gift:D

Don't call them. If they miss it they will come looking for it. tell them you don't know what happened and ignore them. Not like you work for them anymore. If they take it back you could leave it be or you could inform your bank you did not authorise such a transaction and they will reverse it.

Its not stealing. If i gave you money i wouldnt expect it back or accuse you of stealing. One person gave another a sum of money, thats all there is to it

I think i'll pretend i never noticed the money. If they call i'll give it back. If not i'll spend it.
I'll leave it sit there for a month or so and if no call i'll invest it wisely:D

200 a week is below the minimum wage, how many hours did you work, maybe your commission was supposed to bring you up to min wage level but you sold nothing = no commission so they had to make up the difference??

I don't know anything about how sales or commission's work, so I am probably wrong thats just the first thing I thought of when I read the post.

It was up to me how many hours i worked. I think they expected to not go home until a sale was made or it was too late to be out.

They cannot remove the money from your bank account. They can request it back, and legally they are entitled to it back too.

For €200 they probably won't take you to court. If they did, you could probably get legal aid and the solicitor could wrangle a repayment schedule of €2 a week or something ridiculous.

I can't believe you are contemplating keeping the money though. It's a bit desperate. Next step is exaggerated personal injury claims!

Just in case you're wondering what I would do.. In one of my jobs the payroll guy accidentally paid me €10,000 instead of the €1000 I was meant to get in my FINAL payslip (that was my pay for the whole month by the way!)

Naturally I gave it back. You don't know when things like that can come back to bite you in the ass.

It is stealing, both legally and morally. If an ATM overpaid you by mistake, you would have to repay that also.

This could be in lieu of a weeks notice, esp if the OP hasn't received a P45.

  • Registered Users, Registered Users 2 Posts: 1,857 ✭✭✭Bogger77

But the OP should check to see what the story is.

no way it's in your account.. its your money now. keep it,spend it. they cant do anything about it?

If on the otherhand they hadn't paid you the first week, I assume you'd take the line too that it's their mistake and not to bother them??

    (yes, I was being sarcastic)

At the end of the day you have knowingly recieved money in error, you gotta give it back both legally & morally.

no you dont have to give it back.

someone put money in my account and when I went to the bank she told me I wasnt obliged to give it back, but I did as it was a relation who made the error,I would look at it as a bonus for doing a sh1tty job :)

Was that a legal expert in the bank?

Of course it wasn't. The bank isn't allowed to transfer it back without your permission.

Legally, you have to give it back because it's not your money.

Was the second weeks pay in lieu of notice?

Is that one of those below minimum wage jobs?

If it is, I'd just hang onto it for a couple of weeks and see if anything is said.

Don't spend it and if they want it back, just return it.

I had one of those door to door marketing jobs a couple of years ago, for just under a week, was absolute hell. Was paid two weeks wages on quitting, never returned it (felt a bit sick towards the job seeing as I was way below minimum wage unless I made a massive commission, which is impossible to make seeing as you're trying to sell Satellite deals to the poorest and roughest places in Dublin).

Never heard from them again, I assumed it was because they knew I had worked a full week, paid me well below minimum wage and were worried if they came after me for it, I'd report them under the National Minimum Wage Act.

This happened to a friend of mine give it back as quick as possible because they'll charge u for the money and add a tax ontop of it saying that if ya don't pay it their going to charge u with stealing.

  • Banned (with Prison Access) Posts: 4,255 ✭✭✭Yawns

How can they add a charge on top of it and then threaten to report him for stealing? Get a grip.

If I put money into your account tomorrow then demand you give it back straightaway or i'm gonna charge you a tax on top and if you still don't pay I'm gonna report you for stealing?

The company gave him the money he didn't go and steal it did he?

Your 'friend' was an idiot if that story was true btw.

Bull. All they can do is ask for the money back.

Maybe it's an automated payment that no one has cancelled (thats how I got paid an extra months money when I left one company - I paid it back) so I wonder what will happen next week.

LOL if they do the same again what will you do then :P
