Quick lease question

    Hi guys,

    Just looking for a few opinions about my lease.

    In my lease, there is a line saying 'All residents must abide by the Residents' Rules at all time'. Now if a tenant was never shown these rules and never signed them, having only been shown the lease and signed the lease can they be legally expected to comply with these Residents' Rules?

    Well, the terms of the lease agreement itself could be regarded as the residents' rules. However, if the rules are contained on a separate document then you should have been shown them at the start.

    I wouldn't see how this could be a problem though, on a practical level, as I've never come across a lease agreement that is very onerous beyond the obligations put on tenants under the PRTB 2004 Act. But in answering your question, yes you would have needed to be shown the rules if they are on a separate document apart from the lease agreement.

    Thanks, that's what I thought.

    So what would happen then with regards to the tenants? Would they be expected to change their behaviour / activities or would the lease have to be amended to include the Residents' Rules?

    I just find it a bit silly that we have a set lease which is supposed to outline everything then a separate set of rules that the management company can change whenever they want.
