wondering where i stand

    Hi, i recently moved out of my house as my lease contract was up and rang UPC/chorous to let them know i will no longer be continuing to be a customer of theirs. When i was taking up the service i specifically told them i did not want a year contract as i only had a 9 month lease on my house and i made this clear as could possibly be.

    i was not in the house while they came to install the service and did not sign any contract at any time with these people, my house mate was there when they came to install it. now when i said my 9 months is up on my house im moving back home and basicaaly thats it,im not your customer anymore,i turned off the system when leaving.

    they constantly keep saying i need to pay 100 euro cancellation fee to cancel my year long contract that i had made clear i did not wish to take up and was told that it would be grand there would be nothing like this whenever i was moving out! as i didn't sign anything and made my situation clear before taking up the service im wondering where i stand on the 100euro cancellation fee? any advice would be greatly appricated,thanks

    As far as I am aware they only do 12 month contracts so I dont think you'll have much of a choice in paying the cancellation fee. Tha agent you were onto probably just agreed with everything you said and gave out the wrong information(like they always do with me).

    thanks for the quick reply! bit of false information on their part, but that doesnt surprise me at all with this company,il know never to take up another service with them ever again. and if anyone knows how they keep saying i signed a contract when i clearly didnt,i might ask them to show me where they keep saying i signed because i didn't sign anything so that could be fun. they have been as difficult with me.

    That could be worth doing. If you never signed anything and never agreed to a 12 month contract, then there is no contract. :)

    Ask for your call under data protection, every call is recorded these days.

    If they provide it you have a record of your contract being only for 9 months. If they don't provide it, what contract?

    If you can prove that they said that your contract was 9 months then you may have a case. Otherwise its very clear in the terms and conditions (which you would have agreed to when signing up) that the minimum contract is 12 months, and unless you can prove otherwise I dont think you have much comeback Im afraid.

    It all comes down to UPC and the recording of the call.

    If they provide it, then the OP has a contract for 9 months. A verbal contract is binding on both parties.

    If they don't provide it. The OP never had a contract as there is no record of them ordering UPC so how can they be tied into something that doesn't exist.

    Ask them to see a copy of the signed contract.
    As they don't have one, should be the end of it.
