Neighbour draining his garden into ours.

    Ok so basically the neighbour behind our house has put a hole in our back wall to drain his garden (which is higher) into ours. He has totally paved his garden as far as I know and from the looks of it the extra surface area of water will turn our garden to mush when it rains.

    Now I'm going around to him later today when he's home from work to tell him to fix the hole, but from what I have heard he will possibly be in my face about it - possibly aggressive.

    My question is what avenues do I have to follow to get him to rectify the situation and to stop him from just driling another hole in the wall in the future? I.e. is it a planning matter etc?

    This is probably the same as if he had some trees planted at wall and the branches are over hanging into your property, he is responsible for any over hang.

    If you don't get anything when meeting him later, I would block up the hole he drilled. Its not right that any water from his garden goes into yours.

    You cannot just drain your yard into someone elses property. Planning should state that you have to deal with surface water runoff.
    And you definately cannot just make a hole through a party wall.
    Contact your local planning office and make a complaint before you talk to the neighbour.
    Best to make a written complaint and keep copies of all correspondence with the Council.
    If he wants to hard surface his yard he should also make allowances to deal with the runoff water by taking it back into a stormwater drain or similar.

    Block up the hole with a waterproof mortar. End of story.

    It's all sorted. Turns out the builder was a bit of a cowboy, and the guy in question didn't know about the hole - it's blocked now.

    Thanks for the advice guys.
