    hey all. partner and i in process of buying a home. House got full planning permission as did associated ground works, bio unit etc. Our neighbours are up in arms however, claiming our biounit will be too close to their well. (unit not in yet)Our builder and solicitor have informed and proven to them that the planning permission has been granted and that they really dont have a leg to stand on and cant do much about the situation.

    what does everyone think? can they cause us huge problems or delays?

    A Grant of Planning Permission is a legal document carrying with it rights and constraints. However, your neighbours also have rights and if you are building beside them you will have to live beside them.

    If your treatment system and percolation got planning permission then I would assume there is adequate separation distance between the system and any water well, at least there should be if everything was shown correctly on the planning documentation.

    If you are planning on moving the system, you would be advised to clear any movement of the system with the planning officer before you do it, as it can affect your planning permission.

    Our builder and solicitor have informed and proven to them that the planning permission has been granted

    Listen to your Solicitor. A Grant of Permission is a legal document.
    Your neighbours had every oppertunity to comment on / object to your planning application or appeal the decision to An Bord Pleanala.

    Build your house, treatment plant & well exactly as per your planning drawings.
    Build your house, treatment plant & well exactly as shown on your granted planning permission documents and your neighbours won't have a leg to stand on. (The time for Objection has passed)

    Permission was granted - comply fully with it - end of story.
