Being Notified of a Ticket/Violation?

    If one is pulled over by the Garda and found to be in violation (no road tax), are they supposed to let you know if they are issuing you a ticket and/or fine? Or can they waive you on and then surprise you with something in the post a few days later?

    If it's the latter, are they legally required to at least tell you that you are in fact being issued a ticket/fine, albeit not then and there?

    Not to sure but i got caught speeding and had it quashed because i never received it within 28 days of the offence

    Did they at least tell you that you were going to receive a ticket when you got stopped?

    Nope, not required to tell you anything.

    Common courtesy would dictate that you be told but it's not legally required. 99% of guards willl tell you though

    Hmmm. Guess it's a waiting game at this point. However, if I don't get anything in the post in 28 days, does that mean I'll be able to have the charge/ticket dropped?

    no, ticket can be issued 6 months from date of offence. You have up to 56 days from the date the ticket was issued to pay it before it goes to court.

    I got stopped last August in my dads car and the tax was out around 3 weeks. The gaurd said he was going to send me a fine and it would only be around €40, I said OK, it didn't bother me really. Never received anything and forgot all about it until last Thursday when I got a fine in the post. I rang the Traffic Dept and told them issuing the fine nearly 10 months after the offence is taking the piss and they can <snip> off for themselves if they think I'm paying it.

    They said sorry, it was an error with the computer or something and payment wasn't necessary. Idiots.

    when did this change. it was always 28days. i got caught on speed camera and it came ages after the offence. i got legal advice and wrote back to lucan garda telling them this. they then dropped the charge.

    Legally its 6 months before it goes statute barred as its a summary offence.
    Obviously, someone getting a ticket 6 months after the offence isn't ideal so they prob just cancelled it. They didn't have to though

    they wont let you away with much now anyway. Revenue is down in all Government Departments by as much as 30%. We cant keep going to the EU for handouts... So if you get caught now breaking any laws expect the worst :(

    Their meant to be rolling out the new mobile speed cameras later on this year, so it will just be a fine in the post if your caught exceeding speed limits ...
