Contracting question

    I have been working for a company for nearly 4 months now, after being redundant for a year I jumped at the chance to work as Id been looking everyday and really was getting disillusion. But the guy employing me got my contact through a friend so no agency was involved and knowing I was eager to get back working offered my very low wages for a weeks pay, under contract. I agreed and was glad to be back working. Now after proving my worth and showing I was good at my role, I had to ask for a rise and it was pityfull, the normally daily rate for my role would be double, especially being contract. I have nothign on paper and get paid by direct debit into my account. What rights do i have as fair as bank holidays and am I allowed for days off with pay, any advice appreciated.

    A day rate contractor does not get to invoice for day's they do not work, simple as that. You do how ever get to pay yourself for them out of the money you have. If you are a day rate contractor then you should be invoicing the client and collecting VAT of the tax man. Not to forget paying PAYE/PRSI on the salary you are paying yourself. But then again you do get the nice little extra's such as expenses.

    A temp fixed term contract is a total different kettle of fish. Of which I know little except its the worst of day rate contracting and the worst of perm work. And the benefits of neither.

    If your sure the day rates for your field/experence are better than your getting then go after one of those contracts. If there aint any contracts out there then be happy that you have something coming in and stay looking till you find better.

    Key question:

    Do you invoice anyone for your time? If yes, then you're really a daily-rate contractor as per the previous post.

    But if, as I suspect, you're not invoicing and in fact PAYE is taken out of your wages, then you are just a temp. I agree with the previous post about this being the worst of both worlds. However you do have some rights, including minimum wage and holidays.

    Sorry to drag this up but what is the difference between an employee and a temp contractor? Can a temp contractor after two years with the one firm be entitled to redundancy if there's no fixed end date stated on the contract?
