I am taking a year off from golf because i just dont have the time for it this year. I was chatting with a past captain of the club yesterday about this and he tells me my handicap will laspe, so i would have to put in another 3 cards next year in order to get it again and no matter if i put 3 cards in that would get me a 22 or 24 handicap the handicap sec. will give me an 18 handicap. This seems unfair to me as i am playing off 23 so there no chance of me getting better after a year off. What is the point of joining a club again if this is the case? Can they do this?

I'd personally give a higher handicap than 18 if I though one were warranted... sometimes there's the "sure you're a man and you have 2 arms and what would you want more than 18 shots for" attitude and it can make sense... sometimes you'll see a run of decent holes and that would steer me to 'only' award 18.
But you have a handicap and a playing history already. If I were you, I'd print off my playing history from the last while and then I'd attach that history (with an accompanying letter) and your 3 new cards next year.
If you explain in the letter why you had to let your handicap lapse, how you haven't hardly played in the interim, how you'd like to resume at your previous handicap (assuming your cards aren't better) yada yada... The sec should take it all on board more-so than if you just hit him with the 3 cards.

Yes, assuming you have history on golfnet then print it all off from previous years...

I think the advice is incorrect.

When you take a Leave of Absence, your handicap is suspended (you cannot use it in official competitions) but you should be able to resume it when you renew your membership.

Could you not just play the 3 times this year?
