Internet refund, postage

I regularly buy boxes of earplugs from ebay, and sometimes use different sellers depending on what's available at the time. Last week I bought a box from a seller I hadn't used before, and they are rubbish, they don't work at all. They don't block out any sounds, not even quiet ones like rain or a dripping tap. The seller says that they will refund me, although they say they don't believe that the earplugs don't work. I paid £26 for the box, and the postage was free. The seller says that when they refund me they are going to take off £3 for the postage they paid to send them to me. Can they do this?

No, they can't do that. You will be expected to pay for return postage, but should get everything you paid back. Start a Paypal dispute, then escalate that to a claim once the package has been returned. Use registered post, or you'll get nothing.

I emailed them to say that I expect a full refund and will start a claim otherwise, now they say that they are just going to send me a new box, and will send the other box back to the manufacturer with a copy of my email. I don't want them to send me a new box though, I have already ordered another box from a different seller. Am I entitled to demand a refund, or do I have to accept a replacement? And does sending it to the manufacturer have anything to do with me - eg - would I have to wait for the manufacturer to agree they are faulty before a I get arefund, and what if the manufacturer doesn't agree that they are?

    Simples
file a paypal claim for not as described. Make sure you mention when setting up the claim that youve sent the item back with recorded delivery and youll get a full refund

Oh, I can't believe the cheek of the seller! They write back to accuse me of having ordered the item by mistake and not really wanting any earplugs, and say that it would have been "nicer and alot easier" if I had just admitted this at the start! I can't believe how annoyed this has made me, not only am I stuck without any earplugs now until new ones arrive but I had to go to all the hassle of sending the ones they sent me back, and all because they sent me poor quality ones and they accuse me of it being my mistake! Well they are totally getting negative feedback after this. The only reason I'm not leaving feedback now and filing a dispute is because that may make them drag it out for a long time. Hopefully they'll recieve the earplugs in a couple of days and refund me immediately.

I responded to their email by saying, "I have not ordered anything by mistake. I needed a box of good quality earplugs and unfortunately recieved a box of poor quality ones. I have ordered another box from elsewhere as I don't wish to recieve another faulty box from you."

Now I hope that my response won't make them cause even more problems. I think it's so rude that they accused me of that, and that they tried to get out of paying a full refund. I am really annoyed! I am going to check the recorded delivery status every day, and the minute they sign for it, I will email them to say that I expect the refund that very day.

He is really pissing me off! Now he says:There is nothing faulty about the earplugs you have recieved and these are the exact same ear plugs the you have previously purchased from other buyers looking at your feedback and i take great personal offence at being accused of promoting unfit for purpose goods, when hearing prevention is our business, speciality and a area of expertise we have many many years of experience in!

So I responded:Then you can see from looking at my feedback that I have used these earplugs before and know what they should be like. I have tried a few pairs of the ones that you sent me, and they are undoubtedly faulty, as they are not blocking out any noise at all, not even quiet sounds like rain. How can you say that they are definitely not faulty when you haven't even got them back and tested them yet? Accusing me of lying by saying that I ordered them by mistake is extremely offensive to me. I need earplugs, and now I am left without any until my new box I ordered from elsewhere has arrived. At any rate, I am not going to argue this further. Do you want to refund me to resolve this amicably, or would you prefer to just leave it to paypal to sort out?

Earplugs come in so many different varieties and noise level and sizes, its almost impossible for someone to say a partiocular one does / does not work.

If you bought based on a NRR value (NRR vakue of 32 would block most sounds, but not alarms) (NRR 26 just blocks some sounds) etc etc. you would be able to claim full cost, but considering earplugs are just of pieces of foam (different densities) then I doubt if the claim would be successful.

I use www.earplugsuperstore.com - even when shipping from USA is added its quite cheap and each and every earplug is explained + sample packs are available.

well, they refunded me today, and I decided not to bother with feedback, until I saw that they had sent me a very rude email, accusing me of stealing some of the earplugs (who would want to steal earplugs that don't work?) and complaining that I hadn't also sent the used ones back. I was so angry that I left them negative feedback.
