    Hi John,

    Now that the ash cloud is causing flight disruptions again, does the package travel directive still work if the airline cannot get me to the port where a cruise is leaving from?
    All this was booked under one package at an EU travel agency.

    I am very worried we will lose the entire cost of the trip if we cannot fly to the port due to the new disruptions.

    If your trip was booked as a package holiday, you are protected under the Package Holiday Directive. If your flight is cancelled and the tour operator cannot get you to your destination they must offer you the choice between a replacement package of equivalent or superior quality, a lower grade package with a refund of the difference in price between the two packages, or a full refund. Passengers on package holidays who are stranded in a destination must be looked after by their tour operator, and the operator is obliged to get them home.



    Your holiday is a package holiday if it has been pre-arranged and sold at an inclusive price by a travel agent or directly by tour operator, covers at least 24 hours (or include an overnight stay) and is made at least of two of the following components:
    • Transport
    • Accommodation
    • Other tourist services that are not directly linked to transport or accommodation but make up a significant part of the cost and package (e.g. guided tours)

    Who would be the body that would handle rogue travel agents who refuse to do this?
    I would assume small claims court, however its limit is below the cost of travel.
    I can find many documents on the Package Tour Directive but none state what to do if the Agent disagrees (this has not happened yet, but I like to know what I am talking about if the situation arises)

    Hi Jumpy, The Commission for Aviation Regulation is responsible for licensing travel agents and tour operators in Ireland. They also have a role in investigating instances of illegal trading but they do not have any involvement in handling consumer complaints about travel agents.

    Complaints of this kind should be made to the National Consumer Agency (NCA) who are empowered to oversee the enforcement of package holiday legislation. However the NCA cannot bring proceedings on behalf on an individual consumer.

    If your claim exceeds 2,000 euro but is less than 6,348.69 euro, you will have to bring your complaint to the District Court. You may choose to represent yourself in court or you can contact a solicitor.
