Heres an Idea on how legalising Drugs could be done

    Drugs Currently Available of the market

    * Cafeine,Nicotine,Paracetamol :
    As far as Im aware no legislation on who can sell them ie I mean any shop can sell them but in some cases only to people over a certain age group, Im assuming tea/Coffeehas no age limit

    *Alcohol :
    Anywhere with an appropriate license ie Pub, Offy, Restaurant ectt... Has to have a relevant license to sell and there are penalties

    *Non prescition Medication (Codeine):
    Only available from specialist suitaby trained ie pharmacist

    *Prescription Medication:
    Only available from specialist suitably trained ie pharmacist and with only a prescription from a Medical practitioner who has diagnosed that the person needs this type of Drug. Rules and regulations also in places and i'm assuming that there is penalties in place for a pharmacist who gives out prescription medication without written approval from Doctor, whether these penalties are ever exercised by the authorities I have no idea.

    Mull these together and maybe possible that we can come up with a way to legalise marijuana or some other drugs. My plan.

    1) In order to be able to avail of these Drugs you need to have a certificate from a doctor to declare that you are in good enough health to buy this stuff. ie any one over the age of 18 has to go to the Doctor, ask for a medical Test or whatever from the doctor to be given a Dope card lets call it for now. Put a charge of 80 euro for this. The Doctor does the Check and certifies you as being able to avail. Then you are given this card by garda on Doctors recommendation. This card has an expiration date of lets say 1 year. This may lead to Doctors specialising in DOPE card offers just like you have specialist. which I would be in favor of.

    2) Have premises where you can buy these Drugs with the same rules and regulations for current Alcohol licenses except that who ever owns these premises must have a training course done on the effect of these drug like a watered down pharmacist course and have very strict rules to follow we can discuss that later. Only people who have the Dope card which was previously been supplied by the doctor can purchase these drugs.

    3) When you go back for a new card after the expiration date the doctor conducts more tests and also involved would be an addiction test. Not sure how this is done but maybe need to consult with family members ect.. If there is no sign of addiction a new card can be authorized. If evidence of addiction is found there will be no Card given and maybe a care plan can be put in place to help.

    Cultivation -

    In order to cultivate the marijuana you must obtain a license again from the Garda, with 2 types of cultivation licenses

    1)Commercial cultivation- To be sold to the Premises with only a license to sell. This may lead farmers to expand on what they currently grow , plus after the THC part ie Buds have been harvested then the rest of the weed can be used for paper cloth ect...
    I imagine that the license for this would be no more than just asking the garda permission to grow and some type of paper work involved, let say maybe 100 euro for a 5 year license or something like that.

    2)Personal Cultivation- As long as you have a dope card you can cultivate and smoke your own but there will be a max of only growing maybe 5 plants at a time.

    Cons-

    Q : Just because you have a Dope card you can sell it on to anybody
    A : If this is found to be the case well then the same rules should apply as the current rule of buying Alcohol for minors, If you are found to be giving these drugs to some one without a DOPE card you will be penalised,prosecuted ect..

    Q : Cigarettes are legal but there is still a black market for them so why wouldn't the black market still continue
    A : Black market Cigs come in from other countries and it is the price that is making it the black market more appealing to people. I know I would much rather purchase Marijuana from a recognized legal source than a shady character. Also I'm not too aware of a black market for Alcohol in Ireland.



    Anybody found breaking these rules should be liable to penalties maybe extremely harsh penalties but it would all be done in an extremely controlled way.

    I'm sure there are holes in this argument and that is why I posted it to thrash them out. There will also be people who just don't want these things legalised and want alcohol Banned that is for another thread, this is a what if scenario I have posted.

    All Times and prices in here are just a rough draft they can be longer or shorter more expensive less expensive, That part I haven't worked out but for the moment i have just put in some ideas

    alot of security would be needed around this. drug dealers will just burn the crops to the ground as they will be losing millions !!! abit like what we are seeing with the head shops atm !!

    Interesting point gaz wac but if these drug dealers where smart there would be nothing to stop them becoming farmers and cultivating the crop and doing what they are currently doing but in a legal manner, Much like the speak easy during prohibition era america had to adjust to being legal after the prohibition era ended

    America basically has decriminalised/almost legalised it now. Likes of Spain you can grow your own.

    Real shame about the UK going with the tabloids over the scientists. We always seem to do what they do.

    I like this tbh. Most of the hype regarding soft drugs comes from people (and kids) with previous conditions doing drugs and having complications (dying, bodily damage, mental damage etc). As part of this, i'd suggest a training course to introduce people to the drugs available, their effects, usages, etc. There's an amazing amount of crap floating around society about drugs and how to use them. Education would clear up a lot of mistakes. Lets face it, we want the easiest, and most enjoyable high. Less experimentation means less risks.

    Introduce hefty fines of €100,000 - €200,000. Failure to pay would include the seizure of assets, and prison time. Would cut out most time wasters.

    The black market exists because of price... simply put we're forced to pay way more than any other state in Europe. A reasonable price will reduce demand for a black market, along with decent quality. The blackmarket will never disappear entirely. Trying to do that is silly. Just remove the desire for the majority.

    this is the tye of forward thinking needed to turn a troubled country. there is a massive market there that will continue no matter how bad things get. the obvious choiceis to legalize so the govt can benefit form the tax income on it. it will be easier to police the supply of it when it is all above board. there is a so called "war on drugs" which can only be compared to fighting a forest fire with a garden hose. the drug trade is probably the biggest industry left in this country. im speaking as a person who has never touched even a cigarette never mind marijuana and i am all for this idea. the money that is been spent on trying to stop it could be better spent on trying to control it and educate people about it.

    You could probably add some personal laws in too. Such as it still being illegal to smoke in front of a minor or to allow a minor in your company, who you know to be a minor, to smoke it. Buying it for minors should be harshly punished too. Also if you are in charge of children or a vehicle although I'd imagine some of these are obvious no-brainers already in place with alcohol.

    Anything less than equal status with alcohol (ie, you walk into an off or on license and buy it) for the drugs I want legalised isn't acceptable to me.

    Although, pragmatically, I might consider your idea as a temporary stepping stone to full equality with alcohol.

    As part of this, i'd suggest a training course to introduce people to the drugs available, their effects, usages, etc. There's an amazing amount of crap floating around society about drugs and how to use them. Education would clear up a lot of mistakes. Lets face it, we want the easiest, and most enjoyable high. Less experimentation means less risks.
    .

    You May have to Attend a Lecture of something before going to the Doctor or do a "theory test" Before hand might not be a bad idea, Give you education on what you are using. Dont want to put too much red tape in there but it can be simple. Maybe even do your own research and have to answer questions posed by the doctor to say yes you are educated on the effects as part of the DOPE card assessment.

    I Agree with you on this and If everyone was liberal and free we may get that idea, But unfortunately they are not, there has to be a little give and take in everything and I believe that " We would give in a lot here " But the Reward at the end would be worth it. i.e being legally Stoned :)

    This is what i have made of recent happenings:

    • Headshops are selling complete muck.
    • There are hallucinogins being sold as "weed" in headshops.
    • If headshops sold real weed and cannabis they would be selling better and safer produce.
    • It seems that if you are on the so called moral high ground, you can bomb,burn and attack your way around the laws of this country.

    RTE are running a Documentary on Headshops next Sunday night (In Place of the Mentalist :( ). Be interesting to see if its Nuetral or Biased

    I propose we all (as in the Law) "turn a blind eye" to home growers. .and still keep the pressure on organized crime and dealers.

    I cannot see how growing some weed and sharing your harvest with your friends is a crime.

    Unfortunately at the Moment it is. They could make the Law that 3 Plants Maximum at a time to be harvested or something like that, But then there would not be much in the way of Tax generating, which I believe is one of the ways to tap into the mind set of the anti-Legalization lobby and get them listening to us.

    I agree with you 100%. I Suspect a Majority of people in society would not go for legalisation unless there was some tough regulations involved and this is a way to ease their fears. If it could go straight to a society that everyone can grow their own without the fear of legal repercussion that would be UTOPIA. I'm there man.I don't think the Spanish, Portugese or Dutch way would ever work in ireland, As a nation we are still a little bit too catholic conservative in our thinking but that is changing, and hopefully one day lead to this "UTOPIA"
