Werent paid for services, small claims court?

    Hi,

    Me and my partner did some carpentry work in the shop, agreed the cost of work before we started. However as soon as we finished he paid us only half of the amount saying that he understood it differently.
    Is anything we can do to claim these money back? Is a small claims court a proper way to go or our situation is qualified as debts recovery?
    The amount we are owed is small indeed but we would really want to punish this guy somehow as he apparently did this before with other people.

    There are new rules in the Small Claims Court for inter-business disputes but they do not extend to debt collection. You would have to sue in the ordinary courts.
    The District Court has jurisdiction up to €6,300. In my experience, proper paperwork is crucial. Copies of estimates and invoices, on headed paper, are almost invariably required.
    You could also consider a complaint to the Garda under Sections 7 & 8 of the Theft Acts of obtaining a service by deception.
    The Guards are not usually helpful in cases like this, to say the least.
