    A friend of mine got sacked for being late after warnings and went to sign on and was told that because it was her own fault she will be suspended from payments for 9 weeks.
    Does anyone know what the law around this is as she is very upset.

    She upset about getting the sack or the fact her payments will be suspended for 9 weeks?

    If she was told it was suspended for 9 weeks then not much else she can do.

    She was upset at getting sacked firstly, then when she went to the welfare office and was told that becauce it was her fault she got sacked that she is on her own for 9 weeks she has been in bits.

    Loss of employment


    You must have suffered a substantial loss of employment in any period of six consecutive days in order to be eligible for Jobseeker's Benefit. This means, you must have lost at least one day's employment and as a result of this loss be unemployed for at least 3 days out of 6 days. Your earnings must also have been reduced because of the loss of employment. You may be disqualified from getting Jobseeker's Benefit for 9 weeks if you:

    * Left work voluntarily and without a reasonable cause
    * Lost your job through misconduct
    * Refused an offer of suitable alternative employment or suitable training
    * Are aged under 55 and get a redundancy payment of more than €50,000. The exact length of your disqualification (up to nine weeks) will in practice, depend on the precise amount of redundancy payment you received - see below.

    that dosent sound right
    if they want to get rid of u without redundance payment they have to fire u for a reason lateness is the most common and easest to do!!!!!

    Why doesn't it sound right?
    The OP admitted her friend was late after warnings, it would be a totally different case if she said that she was unfairly fired for being late when she wasn't.

    The law is very clear on this. Payment can be suspended for a period of time as a result of misconduct. She might appeal but looks like the employer would easily win this if they can prove they gave her a number of warnings in relation to being late for work.

    what about myself,had a contract that stated work start time was 8, we had a half hour of overtime before work every mornin so half 7 but it was made clear to us at the time that all overtime was volunitary! the bus i used to get to work arrived to my work at half 7 every mornin and then i had a 5 minute walk to my work station,so got in every day at around 7:35. a new boss started from january and i hadnt been in any trouble from any of the higher up bosses in the 6 months i had been there before this guy started! after 1 day he said he had a problem with me and constantly for the next 2 months he kept at me, over the simplest things and eventually told me that i would have to be let go, so im just wondering where i would stand on the social welfare, would i have to wait the 9 weeks?

    That'll teach her to be late for work.

    Why do people continue to be late for work after warnings?

    She'll find it hard to get any new job.

    This sounds like bullying more then anything.
    Have you tried to bring this to the attention of the higher up bosses?
    If the overtime was voluntary and unpaid then they cannot possibly use that as a reason to fire you.
    There is also a very detailed process of warnings etc that must be gone through before you can be dismissed just like that.

    But to answer your question, it would depend on the official reason that was given for letting you go as to whether you have to wait the 9 weeks or not.

    jimoc is dead right

    the problem at the moment is bosses attitude .most people are afread of geting fired and they take advantage eather in cuting wages forcing unpaid overtime etc. it another form of bulling in a lot of casess
    its up to the goverment to deal with this (but they dont want to. just berry their head in the sand)

    this is were " people before profit" comes in a lot of companys let people go not becouse they were loosing money but for profit prentage

    was talking to one of my former work mates since i posted here and the certain boss who i was describing has since been kicked off site because of 3 more cases of bullying that have since been brought against him, so just goes to show what he is like! he didnt lose his job, was just moved to a different site as its ongoing.
