Family Home issue?

    Hello,

    If a judgement mortgage is issued against one spouse, can the family home be taken?

    What happens if one party has no funds/assets to fulfil the claim?

    My understanding is that a judgement mortgage is a lien on the title and will have to be satisfied either before, or at the time, the property is next sold.

    Do youi mean a judgement against one of the owners, or a judgement mortgage on the property?

    Sorry. I meant just a judgment from a court as in an order to pay damages against one spouse.

    Can they take the family home?
    If one cannot satisfy this order for damages, what happens?
