Recovery Truck outside house - is it legal?

    A neighbour of ours has taken to parking his Recovery truck on the stretch of footpath opposite the outside of the house. To get out of the driveway we have to literally reverse up onto the field and then go forward to get out. Now the problem is not the awkward reversing or even the eyesore, its the fact that you are reversing completely blind.

    So the question is: Is this legal for him to do? (not sure if this breaks the charter or not....)

    Before going running to the courts perhaps a chat with your neighbour might help?

    Oh for sure! I have no intention of involving the courts or anything that drastic. All I want to be able to do is know if I am in the right or not so that I can tell him its completely not on.

    I have already talked to him and his attitude is: 'Deal with it'.

    Depends who owns the land- is there a management company around.

    Drop in for a chat and ask him nicely can he park away from the gateway as you are finding it difficult to get out.

    I don't quite get this bit. Do I have it right that your driveway is along a field or is the field a separate property?

    Its not a great idea to reverse out on to the road in any case - quite easy to run over a small child.

    As above: I did ask him nicely to park away but he refuses.

    Its a normal estate, where there is a grassy play area for the kids and it is impossible (no joke) to get out of the driveway, be it reversing or pulling out headfirst to avoid it. And as you said, it is dangerous for the kids! There is no way to see if anything or anyone is coming and I am scared to death about not seeing some small child.

    SO to recap, it is a residential area that surrounds a green area. And Its is a council estate in Leixlip.

    Does anyone know of a course of action that can be taken now that its clear that the possibility of having an reasonable adult discussion about it has been be rejected by the owner.

    Does this guy have a boss that can be complained to?

    Talk to the council and see if commercial vehicles can be banned from the area. That is assuming its a larger recovery truck.

    Most council’s have by-laws that outright ban vehicle’s of certain weight class’s in residential areas, but I suspect your neighbours’ might be covered under an exemption to these by-laws. But, the parking of any vehicle on the footpath is an offence under the road traffic act. It is also an offence to obstruct a vehicular entrance

    If I remember correctly, the local council there employ a private company (could be control plus) to enforce parking regulations try contacting them
