    Hello, long time lurker first time thread starter.

    I understand that if your partner (in my case a beautiful lady with a great pair) lives in your own property for a certain amount time (circa 2 years) that she is entitled to claim common law wife status. And if the relationship breaks up she can claim half the value of the house / apartment.

    Well, my situation is this.... I bought an apartment at the wrong time (2005) and it has subsequently plummeted in value. I am stuck in negative equity to the tune of 150000euro.

    I was thinking of giving her a one way ticket to dumpsville and forcing the sale of the apartment. I would also claim that by virtue of the fact that she has been living with me for 2 & half years that she is my common law wife and therefore should shoulder half the burden of the shortfall that would ensue after the sale of the apartment....

    Let the dizzy bint carry half the can.... if you will....

    Does anyone here know about the viability of my wonderful plan??

    All advice welcome (except from bitter and twisted women)

    Ha ha..delightfully devious. I can't see it working but best of luck to you! Did she claim the status?..maybe she has to. Get her to claim it first and just make up some crap about wanting to leave her something in your will and then hit her where it hurts

    The concept of a "common law" wife has no legal standing in this country.

    Assuming her name is not on the mortgage nor deeds it all depends on how much she has been paying towards the mortgage and other bills. There's been loads of publicized court cases like this.

    There is no such thing as common law spouse, if you are not married you can not claim spousal maintance.

    If you invite someone to live in your house and they contribute to the house hold and to the mortgage and you don't make them your tenant then they have a claim to the property if they contribute to it long enough.

    So there is your answer, get a rent book, make a tenant arrangemen, that way your property is safe, you can give her notice to move out as your way of dumping her and in the mean time you then can do the whole sleazy landlord role play of the rents due....

    OP, good bakers are hard to find. you sure you wnat bankrupt her with your stupid apt buy and force her to sell her bakery, stop selling baps to the rest of us? cause sometimes yoiu need good ones for burgers and the like.

    Also, if your dumping her, how exactly would you get her to try to claim half the apartment in the settlement. Unless she pays for it? otherwise, wouldnt it be a case of you giving her half of your cash if you ever sold it?

    However, if the Civil Partnership Bill goes through, you could find yourself on the hook towards her, so I'd recommend banging the big-breasted, great-hairness right up until the day before it's passed, then kick her to the curb.

    Its an interesting one, though I doubt the bill will be back dated when it is introduced. The bill was designed in times of property bubbles and I don't know if it takes account of negative equity.

    Not sure how the share would be worked out. If it's based on house valuations, well who'd want say, 20% of the negative equity. If it's based on some notional contribution to the house, it would be hard to expect people to raise it with property prices crashing and the difficulty of getting credit.

    Edit: AH response, the baps are probably the only asset here.

    Indeed, the value of your investment may go up or down.

    In this case, unless they defy gravity or get a substantial investment, they will be in negative equity.
