Wrong Tax Credits

    My Dad has been getting the benefit of wrong tax credits for about six years unknown to himself... He retired from the army about two years ago and he has a pension so they sent him a F12 to fill out.
    Background: Divorced approx 7 yrs (swears he told employer at that stage)
    Tax credits claimed originally: Single Parent (I was still in College at time), paying maintenance (parents separated)
    Old school and has no idea what tax credits are even, let alone to know if he has too many.
    I helped him im fill out the F12 about two yrs ago because I had half a clue. I made 100% sure that when it came to ticking the boxes for tax credits claimed I only ticked the paye tax credit and none other and changed his circumstances to single. I kept a copy of it just in case. He subsequently received as assessment saying that he had underpaid (not by too much) for that year, but that it will be deducted from the following yrs tax credits.

    To my horror I just saw his P60 for 2009, they hadn't changed the tax credits at all and he is still getting the benefit. Plus I didn't fill in the F12 yet and its really late...

    I'm just afraid that in this climate of Revenue out for all it can get its mits on... will they go back to 6yrs and try to claw back all he has underpaid? Should I ring and even bring it to their attention or hope he will fall under the radar?

    He just couldn't afford for a professional to fill the forms out for him so never had any idea he was even overclaiming on his tax credits... he still doesn't have a clue what I'm trying to explain to him.

    Don't know what to do at this stage... suggestions anyone?

    Firstly don't panic. It's not a big deal.

    If you read the charter there is to be no advocacy of tax avoidance on this forum. It is illegal.

    Now, if he is getting the benefit of credits he has not been entitled to Revenue practice is to reduce credits in the following years rather than to come knocking for the money back.

    Fill in a correct Form 12 for 2009 and 2010 and send them in.
