Hi I sent a parcel with 4 phones to envirofone with the freepost parcel they send.

The parcel arrived at them with no phones however 3 were found in a loose lost which an post sent them with other customers as they have admitted there sorting office machine causes damage to the parcels.

Now an post say no refund as it was standard post

Now can I claim with the small claims as I have the package and it has oil kind stains on the package and looks like roller marks.

I also have the name of the person that admitted liability.

does the small claims deal with these cases also can I add on the 15 euro
    ?

    s. 63 of the Post and Telecommunications Act might be a bar on your claim:

Thanks for that but as staff has admitted liabilty due to there equipment I think I should have a case sure if that's the case y offer insured postage and have a dept that deals with missing post

As gahbain7 said, they may have admitted fault, but they are immune from liability unless you can prove that your loss is not due to an post failing to deliver your parcel correctly. I think you'll have a tough job proving that.

You could seek redress from envirofone if they knew the bags were unsuitable for postage yet enduced you into sending your phones by post.

I believe they have a disclaimer telling you to use registered/insured post.
