    Hi,

    I'm new to this forum so not sure what i can exactly write. I bought a television in November as a Christmas present and when in this particular shop i was shown by their staff how to claim my 200euro cash back for buying an L.E.D. Tv . I registered the product with the company online and now recieved a letter to say that this shop was not involved in the promotion when i purchased the tv. Do i have any comeback as it was sold to me under false pretenses??

    Any comments more than welcome!

    You do indeed.

    Small claims court - breach of contract - misrepresentation - negligence - that would get you €200.

    Alternatively, District Court - fundamental breach - rescission contract - that would get you your money back and you give the telly back - I don't think you should go down that road unless you're unhappy with the telly. I'd do the former.

    I agree no shop will want to go to court over 200euros :D

    You can sue them but itll involve two trips to the district court and take six months or so (in the dublin metropolitan district at the moment)

    you could also complain to the national consumer agency which might result in a quicker response


    And although the district court can grant damages for breach of contract/misrepresentation, you need to go the circuit court to get an order declaring that a contract was rescinded (it's the equity side of the circuit court)
