Hey was wondering for example lets say someone is speeding, if an unmarked Garda sees him...could he take note and send the points later or does he have to pull the person over and charge him there and then. Also can off duty Gardas do that too?

A hidden speed camera doesn't have to pull you over

lol I wasnt speeding I am 22 last thing i want is another reason for the insurance to go up -.-

Was just wondering, does that go for other offences too or is their a set process on convicting someone. Yea if it has a camara then yea thats obvious, but an off duty Garda.

you'd seriously want to be doing the dog on it for an off duty Garda to pull you over, i.e. extremely dangerous or drunk or along those lines.

normally, for an FCPS (with the exception of the GATSO), you'd get pulled over. S107 of the Road Traffic Act requires you by law to say who was driving the car if you're not stopped at the time but it's easier to pull the driver over and find out then and there.

Unsure about the rest, but a Garda is never 'off duty' so to speak. They have to uphold law and order, even if they are not roostered for duty.

As said, you would seriously want to be doing some speed or really driving carelessly for this too happen.

On the other subject it would be hard, it's a Garda's word without evidence against your word. Mostly likey I say the Garda would take note of the Reg, and place a marker on the car/look up previous offences.

If the Garda was off duty they couldnt pull you for speeding as their speedo wouldnt have a calibration cert so it would never make it near a court of law.

An undercover garda is not looking at you speeding (unless they are tailing you). An unmarked car (vastly different) is much easier to spot(but becoming harder) and many of these are out detecting road traffic offences, including IIRC speed/tax & insurance offences.
