EU Treaty Rights

    Hi,

I have a visa query relating to Stamp 4 EUFam, and was wondering if anyone has had any first hand experience.

Basically, have any Irish Nationals excercised their EU Treaty Rights in an EU member state outside of Ireland, and then applied for a Stamp 4 EUFam visa for their Non-EU wife or husband back in Ireland?

Seems quite difficult to find out about the definitive criteria involved in making a successful application, so would be really grateful if anyone has any advice.

Thanks a lot for your help,

    Paul.

Not something I know much about, but you may find this or this useful. Have you talked to these guys:
    EU Treaty Rights Section
Department of Justice, Equality and Law Reform
    Irish Naturalisation and Immigration Service
    13/14 Burgh Quay
    Dublin 2
    IRELAND

    Email:eutreatyrights@justice.ie
    Ph: 1890 221 227

Or SOLVIT - who badly need a new website.

You could also try the EU Commission's Citizen's Advice solicitor:
    Siobhan Duffy
    Solicitor
    Citizens' Advice

Advice and information on citizens’ rights in the European Union.

    Hi,

Thanks a lot for the fast reply.

Contacted the first two, but they did not really provide any clear cut, easy to understand definitive answers.

Was advised by Citizens Information that the query was too complex and would be better to contact the Immigration Council of Ireland.

Just thought that someone on the boards may have had some first-hand experience which I could leverage off.

Thanks a lot for taking the time to reply.

Someone may have that experience, but this is probably not the right forum to ask in (your thread in Legal Issues is likely to be more productive). I wish you all the best either way.

    cordially,
    Scofflaw

    Cool Scofflaw,

Am pretty new to all this, so was not sure where the best place was to ask, so asked in a few different forums.

    Thanks anyway,

    Paul

You can give this lady over at the European Commission Representation in Ireland a shout.
    Citizens Signpost Legal Adviser

The Citizens Signpost Legal Adviser is available to provide you with information and advice on your rights in the European Union. If you have a problem which relates to your rights in the European Union, you can contact the Citizens Signpost Legal Adviser by telephone at 01 634 1111 or by email at duffysiob@gmail.com or by personal appointment through the European Commission Representation in Ireland at European Union House, 18 Dawson Street, Dublin 2.

The advice given by the Citizens Signpost Legal Adviser is an independent advice and should not be considered to be the opinion of the European Commission nor will advice given be binding upon the Commission.

The Citizens Signpost Legal Adviser will also deliver presentations and seminars to interested groups on issues such as "Rights for Older People in the EU" and "Legal Entitlements for Women in the EU". If you are a member of an organisation which would be interested in such a presentation, the Citizens Signpost Legal Adviser would be delighted to hear from you.

Have found her helpful and quick to respond in the past.

I think you'll find that if you are an Irish citizen and you wish to apply for Stamp 4 EU FAM for a family member, that family member must have lived with you in another EU country before you both came to Ireland. You must both also be able to prove it.
