payment for bankholidays and sundays from previous employers

    HI There,

    If anybody know, for how long employer is obligated to keeps data of my worked hours? 3 or 5 years? Or mayby that is not a necessary?

    I would like to claim my money from my previous employers, I worked all sundays and bank holidays as a bartender in 3 hotels in the past years so mayby I should go to SIPTU?

    Thank's for any info or advice.

    Siptu won't be of any use if you were not a member and probably because you have apparently left. As for records, 6 years is the legal requirement for holding data.

    I am unsure of what you are attempting to claim here. Sundays would normally form part of your weekly roster and OK, theres the Sunday Premium but its highly unlikely you will succeed in any claim here particularly if your contract (assuming you had one) stated your hourly rate is inclusive of Sunday premium, a neat trick Hotels use to avoid paying the premium, Bank Holidays are a different matter but again you must be sure you did not get time off in Lieu.

    How long have you left this Job? this may also have a baring if you case is to be taken up?

    I'm a siptu member, but i left catering 3 yeas ago. One of my friend, has been paid back but I think he claimed staight away. So I don't know...

    Yes sorry, i forgot Nera don't have a dedicated domain name. Seems you might be in a pickle not having claimed immediately, this said i would go ahead and contact Nera, they are obliged to investigate and it won't cost you anything but bog the Hotel down with paper work and annoyance, they may even decide its not worth the hassle and pay you. I recall a former employee of mine (I was in management at the time), on taking up a new position an employee who had been treated really well for many years had just departed, he claimed non payment of 2 days holidays and the investigated instigated led to the Hotel having to produce 4 years of payslips and rosters, absolute nightmare ( My previous employers had excellent records and the claim was dismissed), my point being if you are 100% sure your owed something, it may be worth stirring a hornets nest.
