dodgy software from ebay

    I bought a copy of Photoshop CS2 on eaby. It arrived today.
    Before purchasing I asked was it definitely a genuine copy and the seller said it was.
    What arrived today is a DVD-RW with Photoshop and various other software on it. There is a Text file with each program which has the serial number in it. There is also a crack file with each program.
    I could have just downloaded this program illegaly myself if this is what I wanted.
    I emailed the seller this morning demanding a refund and he is refusing, stating that it is a genuine copy which is rubbish.
    What can I do here? Can I contact Ebay or Paypal and get them to force a refund and also take this issue further with the seller. Clearly what he is doing is illegal.
    Any advice would be appreciated.

    contact ebay and state that the goods are illegal and take pics to show them....there is easy instructions to report a seller and start a claim via ebay.


    EDIT: Did you pay much ? I have a genuine copy - wasn't considering selling yet - but might....oh..mine is for mac (I have CS4 for PC)

    paid €90. Need a copy for a PC in work.
    Don't really need all the extras that come with CS4.

    Quick google puts it at 170 USD for an upgrade version and 600 USD for a new full install of Photoshop CS2 from the first link. Why would you think a 90 EUR version on ebay would then be legal at such a far below retail price?

    How is this relevant to my problem?
    Bargains are often found on eBay. It's against the rules to sell copies of software on eBay. Seller told me it was a genuine copy. It wasn't.

    Because its an obsolete edition and second hand, it seems reasonable to assume that the seller has no further use for it and wants to make back some of what he spent...

    Pics are useless btw, how do we know what he is taking a picture of is the product he received. He will have to prove its fake by obtaining a letter. It's going to be hard since not many places sell PS.

    Obtain a letter from who? The DVD-R he sent me is a standard blank DVD. No label. Nothing. It contains lots of Adobe software and each one has a crack with it.
    If I didn't receive anything what would happen?
    I thought Paypal and eBay was safe enough for this kind of thing and that my word would be good enough to get a refund? Am I wrong?

    Yes, you will need to go into PC world. Too many chancers out there claiming they got fake goods, when in fact the goods are geniune. Not one single person's word is ever good enough.

    I have to go into a shop like PC World with a Burnt DVD and get them to write me a letter saying that it's not a genuine copy of Photoshop.
    You must be having a laugh?

    Nope, the seller might get back stating to send it back for a refund before PayPal gets to it. Most of the sellers are smart so know what we need is impossible to get hence the reason for selling.

    Most counterfeit items are iphones, GHD's where are easier to verify.

    I would advise going through eBay before PayPal

    File a complaint with eBay about the seller, reporting him for selling warez. See what they say, if anything. You could also contact Adobe and let them know the sellers user ID.

    At the same time, start a dispute in Paypal citing your reasons, and escalate to a claim. See what they say. They'll either help you or they won't.

    Start a dispute always to best way to go. Seller has no way of knowing what you will do next but might think he won't get negative feedback if he does a refund.

    If its the guy I think it is then he has been doing this on eBay for years and has managed to get away with it. Edit> dispite me reporting him on numerous occasions
