Author with a legal question

    Hello there,

    I'm a (wannabe) author and have a legal question that I hope someone here can answer for me.

    If someone is caught selling what appears to be drugs (little white pills) to college students and is arrested, but later the pills turn out to be sugar pills with no illicit material in them - would they be released? Has any crime been committed here?

    Assuming that the person doesn't resist arrest and co-operates fully with the Gardai, then no, no crime has been committed.

    While there may be regulations dealing with the proper sale of food that may have been breached, they are unlikely to get a refund, in particular as the "contract" (for the sale of drugs) would be void due to illegality.

    Of course, there is the slight matter of hospital costs for the vendor.
