    Hi all, just a quick query for those that might know...

    Ex-partner and I married in Ireland. I'm Irish, he's American. We split, he stayed in the country but I left.

    From what I've been told, since our marriage allowed him to stay in the country, now that we're separated, that doesn't apply to him anymore and he must leave.

    Can anyone provide some info on this? I also think that he's staying in the country, but under false pretenses...

    In reality, he should have informed the INIS (Irish Naturalisation and Immigration Services) of the fact that the marriage has ended. I'm not aware of whether you have been divorced or have just separated.

    Either way, in practise he can stay here on the basis of his permission through your marriage until that ends. He won't be penalised for not informing of the separation. If he wishes to stay on after this, he'll have to apply for citizenship or some other form of permission to remain as he won't be able to renew his current permission.

    His passport should have a Stamp 4 with an expiration date. He can remain until that expiration date and then it's up to him to convince the GNIB to renew it. The likelihood is that they won't unless he has an alternate basis for being allowed to stay.
