out of work due to refurbishments,what are employess rights

    Hello,

    Looking for some guidance for a friend of mine ,

    The situation is this.

    He works for a services company within a larger organisation; the services company has employed him for over 4 years.

    The large organisation (the contractor) is about to undertake a large scale refurbishment which will mean that company will have to close for almost 3 months, which in turn means that there will be no work for the employees of the services company. The management of the services company have not informed anyone of the situation but it is common knowledge that this is what is going to happen within the next few months.

    Can the employees of the services company be compensated if the services company is going to be compensated for loss of earnings? If not are the employees entitled to any compensation, can they request redundancy & how much notice should they get?

    If they are in a union they should contact them. If not legal advise would be needed I would guess. I have never come across this before. Maybe others have.

    He has told me that the shop steward is not very proactive on such matters.

    In the past where I have worked in stores that were revamped, they were usually closed for about 3 weeks.

    All staff were 'given' 1 or 2 weeks holidays depending on what they had left at the time of the closure. Anyone who had no holidays was told to sign on the dole for the missed weeks, similar to when a factory shuts down for 2 weeks in August and you have no hols to take.

    If they had PRSI contributions built up they were OK but if they didn't then they were means teated and many didn't get until well after the store have re-opened.

    Thank you for your reply.Someone told me that if an employer has no work for an employee for 4 or more weeks that they can claim redundancy,I will look into this.

    I'm not 100% sure but I think if you are made redundant and get a redundancy payment and are re hired by the same company with in a year you have to give the redundancy money back!

    If this guy gets redundancy he will not be returning to the company.

    What he wants to know,Is he entitled to ask for redundancy.

    Bambi,

    He spoke to union rep in regards to compensation entitlements while refurbishments were taking place,but he was told more or less forget about it.He is now going directly to the union to see what advice they can give him.

    When he gets some feedback I will post it up here.
