10 garda summonses ??

    hi all. i have a little problem here.

    i was pulled over at a checkpoint in raheny last june and just got the summons today.. I had just purchased the car about a week prior to that. i bought the car with no nct or tax and was waitin on the log book to come through so i can buy my taxes and the nct was booked for, but wasnt insured on the car at the time.( i know very stupid of me to have taken the car out. it was my first car and was just impatient frown.gif). and was asked to produce within 10 days. but i was going on holidays the next day so cudn produce the documents. and when i came back. i sorted evryting out, but was told it was too late.

    so am getting done for 10 different things.

    1. no insurance
    2. non display of insurance disc
    3. fail to produce nct certificate
    4. exhibiting void insurance disc
    5. provisional driver unaccompanied
    6. non display of disc
    7. use vehicle without nct cert
    8. valid nct not displayed
    9. failure to produce insurance certificate
    10. no road tax

    am ****ting. dont know what to expect. big fine? ban? or even a jail term mad.gif.
    now i have never been in trouble with the guards before.

    if anyone has any advice on what i should do. or anything at all.

    i would very much appreciate it

    1st offence, it will probably be 500-1000 yoyo fine and a year ban

    Damn that's rough OP. I know hindsight is 20/20 but ur a fool for risking it and even worse for not making sure your documents were in on time....that's the part that wont help you out....you chose a holiday over the law.

    Listen I could murder someome this evening in cold blood and prob get away with a 3 year sentence in this country. Jail wont happen. I'm thinking a fine, maybe up to €1000.

    Thats nasty and as was said your biggest mistake was going on holiday and not getting your details sorted. The judge won't look to kindly on that. Contact your solicitor asap and leave it in his capable hands. At this stage there's very little else you can do about it.

    I think you were asking for it. I know you just bought it and were impatient to get going but look at the trouble you are into now.

    Get yourself a solicitor quick. They may be able to lessen the damage.

    Did you even have a license for the car? Because if you don't, I'd say you'll get a nice long ban, and a nice big fine.

    Your looking at a fine. Its a very manageable situation. Get the documents establishing what you say is true together and go to a solicitor practising in criminal law. Crucially, despite what people say, it is perfectly possible that you will not be banned from driving, although you must expect a fine of some sort (heavily affected by your income).

    Meanwhile this forum is not for legal advice and all you're likely to get is (well intentioned mostly) speculation, which is no good for your peace of mind.

    Get thee to a solicitor pronto.

    no insurance generally results in 10 or so summonses which are easy to get off without a solicitor once you have all your documents in order on the day and for the date in question. You cannot do this as your documents for that day never existed, so get a solicitor fast, and you might go ok...do not turn up without one or they'l throw the book at you.

    Also careful about talking about going on holidays...that makes you look like you have no respect for the law and you may come accross as a smart ass.

    That was really foolish to drive the car without insurance.
    even more foolish to go on holidays and not get the documents to the coppers.

    You SHOULD HAVE asked someone to go to the coppers with the insurance or whatever, that may have helped somewhat. but the fact that you just ignored it all won't help anything.

    Like the previous guys said, get a solicitor to fight your corner.
    As a first offense you may be looked on slightly more favorably, but I would not expect miracles.

    You're basically driving a car without any of the legal requirements, and then didnt respond to what the coppers had asked you to do. *tut tut tut*

    i hate coppers more than most people but you don't just let that sh1t slip by... without it coming back around to slap you in the face.

    sorry but good luck with it!
    hopefully for your own sake you'll get a fine (& learn your lesson?!) :p

    Why are you above the law because you were excited about your new car?
    Why would anyone involved in an accident with you have to claim on their own insurance if you were at fault?
    Why do you think you can drive without a full licence or a full licence holder with you?

    How many other laws are you above?
    Are you allowed rob from people?
    Hit and runs?
    Welfare fraud?

    I'd be really interested to know.

    Assuming this isn't a troll, it's a good thing that someone that deserved to be caught for driving offenses, was caught. No licence, no insurance and no tax, so what makes you think you had any right to be on the road? You deserve a massive fine and lengthy driving ban for your behavior.

    Solicitor all the way and straight away.

    We dont know your circumstances.....what you have, what you dont have etc. Only a solicitor you instruct will be able to give you the best legal advice.

    okay.. i totally know what i did was damn stupid and not acceptable.. and i take full responsibility for my actions. its not the first ive been told i souldnt have done. it was just a bad decision at the time And i truly regret it. am not a bloody criminal or nothing, i have never robbed from anyone or harmed anyone. i suppose am just young and foolish. am only 18 and was just getting into the driving scene which is why is didnt have all the documents or a full license ( which i now possess). i guess i wont complain at a hefty fine and it will teach me a lesson. and as they say. consequences teach more than advice. just as long as i dont get put into jail coz i have so much going on with college and stuff.

    more advice will be nice.. and i also heard they offer you free legal aid ??

    OK, so while I don't think that 1 & 2 should be 2 separate offences, and similarly 7 & 8, it seems to be true that:
    1. You are an (effectively) unlicensed driver
    2. You were driving an untaxed car
    3. " " " " uninsured "
    4. " " " " un-NCT'd "

    Now, I would have a bit of sympathy for you if you had "forgotten" one or maybe even two of the above, as far as I'm concerned, you were just completely taking the pi55. Why should I (or anyone else) pay for my license renewal fee, tax, NCT/maintenance and insurance if you're just not going to bother your ar5e? As far as I'm concerned, you deserve to be put off the road for ten years.

    But if it makes you feel any better, I doubt that will happen.

    There's part of your problem there.
    Driving is not a 'scene' for you to get into, like going to nightclubs or being into rap music.
    Nor is it a right that you have an automatic entitlement to.
    It is a priviledge that the State affords to those who have shown themselves to be a) appropriately trained and b) responsible enough to exercise properly. (Unfortunately, too many abuse that priviledge because they're actually not responsible enough. Most of them get caught sooner or later, though)
