Missing money -

    I have a legal question - However I can speculate what i might do, I am not exactly sure about the proper procedure, so please only answer if you know for sure.

    I chair a committee that deals in a large amount cash.

    One of our committee members collected 900 euro from members in middle of October - this was immediately meant to be lodged into our societies account - this has yet to be done however - he was approached numerous times about it, each time with excuses - most recent excuse was 5th one. While internal disciplinary actions are inevitable, I am cautious about initiating them while he still owes the money .

    From a legal stand point - who should I report him to, if the garda, then what department.

    I would say if the person is not forthcoming with information and/or money and internal disciplinary proceedings are inevitable.... maybe you should consult with gardai.

    the above is purely my opinion but WHEN you involve gardai then internal disciplinary procedures will most likely take a sidestep .... the matter could become a criminal matter as this person is effectively going to be charged with alleged theft, and the civil matter (the committee will most likely have to take a civil action against the person in order to get the return of monies)

    - however in terms of law...as best I understand it ...criminal matters supercede civil ...which would mean that even if you start civil action the matter would most likely be adjourned following the outcome of any criminal action.

    Just to note that the Gardai/DPP may decide there is a lack of evidence to warrant a criminal matter ...or an investigation into the matter may take months.
