Advice re barring order against husband/father, no physical abuse.

    Hi everyone,

    I hope its okay for me to ask this.... basically my mother has decided she needs to split from my father. He is an alcoholic (has been assessed twice) and has been abusive to my mother and me and my siblings for years, but its mental and emotional abuse NOT physical abuse.

    Because he has never hurt any of us physically, I am very worried as to what she can do to get him out of the house. Without going into details the situation is terrible at the moment at home, terrible atmosphere and it is having terrible affects on my 14 yr old sister... she is becoming very withdrawn as she doesnt want him living there either and we are very worried about her.

    My mother went to see a solicitor and she was told to tell him to go peacefully and if not to get a barring order. He refuses to leave peacefully and so my mother is now going to go about getting a barring order.

    My question is really and truly does anyone think its likely she will be granted this barring order? I am worried that because it is mental abuse rather than physical that it might be hard to convince the judge how terrible he really is....

    I am hoping that she will get the barring order. The situation really is terrible and if he doesnt go my mum will have to go about uprooting herself and my little sister and i just dont think thats fair considering its he who has caused this... but I want to be realistic about the situation and I dont want her thinking shes going to be able to get a barring order easily if she isnt...

    I know her solicitor told her she could get one because he is an alcoholic and is disruptive and abusive mentally. But I am trying to be realistic... I don't know what proof exactly we would have of this? As opposed to the physical evidence of physical abuse...

    Can anyone advise me on whether maybe I should just trust the solicitor as I guess they really are the professional and I really know nothing about this area... or should I be skeptical and realistic to the fact we might not be granted the order?

    Doesn't have to be physical abuse to get a barring order.

    Go to your local District Court office and they will help/advise you
