Caught speeding, documentation missing in post, now summonsed

    Any opinions on options?

    Caught speeding, penalty point notification and fine arrived in post. Form filled in, including card details for payment, and posted back in pre addressed envelope. Thought no more about it until summons to appear in court arrives. Documentation appears to have gone missing in post... Have no proof of postage.

    Any suggestions on where to go from here with this one?

    With no proof of postage it will be hard to prove i would imagine, im guessing no charge was ever made against the card you filled the form out with??

    I know this sounds funny, but did you put a stamp on it?

    Cos I very nearly missed it when I got one a few weeks back, that little black box made me assume it wasn't needed.

    Hi,

    You could contact An Post Letter Post customer services, 01-7057600, 1850575859, customer.services@anpost.ie and get a missing in post form. They can send one out, or you download one from www.anpost.ie or get one from your local post office. They should be able to help or give you advice. Ideally you could have paid the fine in the post office and I think you can pay by laser or credit card.

    You will have to go to court for the summons and face the judge but if you at least have some proof of postage, or something from an post, you may get it dismissed. It happend to me and I just let the judge know and he dismissed it (I had no documents or proof of postage)

    Sounds like you were lucky, i think it will depend on the judges discretion on the day in the event it heads to court.

    Thanks for all the replies. Stamp was on envelope. Payment didn't come off card. Turns out there was a problem processing payment so form did arrive. Gardai have agreed to withdraw the case - happy ending!

    lol...I forgot to post mine off and it's just gone past the 56 day mark...anyway around this or will I have to go to court?
    I was out of the country the past few weeks so never got a chance..

    Dont bother. It is the drivers responsibility to ensure the payment is made in plenty of time and to take into account all factors such as delay in delivery. Anyway on the form is a phone number so the fine can be paid by debit/credit card.

    On a side note some people leave it till the last few days to pay the fine and they send off a cheque forgeting that a cheque takes 5 days to clear so the cheque is sent back to them and they end up in court.

    damn...I posted it off anyway and chanced my arm...signed it 5th Dec 2009...
    hopefully they throw away the envelope and give me the benefit of the doubt..
    if not...ah well that will teach me :D
