Employer required to provide P45 ?

    Is an employer required to (legally) provide an employee with a P45 upon their employment ending ? Situation were an employer said it would only be given if asked for! Also is a P45 required to be given to a new employer or can you provide a letter from the revenue with your tax details from your last employment. My understanding is if you start without a P45 then you go onto emergency tax. Is that correct ?

    An employer is required to give you a P45 but i'm not aware of what time constraints they are bound to. www.entemp.ie will help you with this.

    If you do get a new job in the meantime just give revenue a ring on 1890 33 34 25 quoting the new employer's employer registration number (this is available through payroll/HR wherever you work). As we're coming up to the end of the current tax year your previous P45 would be irrelevant to get you started in a new job during 2010, as this is a brand new tax year so we don't need to worry about previous earnings etc.

    Now if you started your job recently i.e. 2009 again it wouldn't matter as far as revenue is concerned as we've stopped issuing tax credits for 2009, which would mean you would be emergency taxed regardless and there's nothing either of us can do at that point without a phonecall from your payroll.

    However, you do need to get that P45 into us if you want to claim tax back for 2009 as we need a complete record of your Pay & Tax before we can release monies.


    And at the end of the day if you're having problems getting a P45 give us a ring on the number above and Revenue will issue a P43 to your former employer to get this information, or you could wait till February and your former employer would send us this with his P35 returns.

    Basically to sum it all up...

    Day 1 in new job you get that emp reg number or if you know you are due to start (like a week in advance) get the emp reg number and give Revenue a buzz so you'll be all set up for your 1st week/months wages with no emergency tax deducted.

    Its a possibility depending on your payroll that you might be emer taxed on your first payment, but you'll get it back through your 2nd payment once everything's sorted.

    I think the employer is obliged to supply you with a p45 within 1 month. Do check with www.entemp.ie though
