should I get a refund?

    I buy a fancy tee shirt for a present for a mate...(size M)

    Turns out it fits fine everywhere except the chest, bit tight.

    I bring it back to be told that they only offer an exchange or credit note for items on sale, and that they only offer refunds on non sale items.

    Do I have to take this or do I have the rite to a refund as the items is not fit for its purpose?

    Can someone help with some info?

    Yes. The shop doesn't have to offer a refund.

    It is, you bought a t-shirt and you got a t-shirt, the only thing wrong with it is the size and thats down to the customer not checking that before purchasing.

    You have 0 rights in this instance

    Its like buying a pair of shoes and you find they are two sizes too small, you should have tried them on before buying them. You can check with the Consumer Connect and they'll tell you the very same thing :)

    The shop is being reasonable to provide you with a credit note or exchange

    Just get the credit note. The shop are fullfilling their legal requirement.

    Get an exchange - no point getting a credit note. They could be gone tomorrow and what would your credit note be worth then?

    Just try on the new item before you buy it.

    You're misusing the phrase "fit for purpose" here. That implies that it is able for the job intended - that it can be worn as an item of clothing. The t-shirt can indeed be worn, it's just not the right size.
