My appeal is being heard by tribunal soon and I willl be representing myself. The xboss signed RP50form which shows he agreed to redundancy owed but since then did not show accounts to department which is why I had to bring it further, he has not appealed hearing either. I presume its going to be very straight forward but is there anything that I should be prepared for that haven't thought about.Has anyone been in a similair situation or advice?

    Hi
Just wondered how the hearing went??
I am in the same boat - got laid off in June of last year, employer couldnt afford to pay me but never bother sending in the accounts, how long did you wait for a hearing???
    Regards,

The hearing will continue and you may find he will submit the accounts as it will not be to his benefit. You should get the redundancy if your win your case .
Compensation is another matter if he proves inability to pay. I have this problem and the former employer now says he will pay 40 euro each month .This will take 10 years !!
You can go to the court and pay a solicitor but if he has not got the money??

if you get a recommendation from the EAT, you will be able to apply to the Department of Social Protection for your redundancy, if he is unable to pay, they will pay you and he will then be held liable

Please don't drag up old threads for new discussions. Atkin, if you want to discuss your W&J situation, start your own thread, I'm closing this one.
