No help from PayPal

Hi guys, I don't know if anyone here can help me out of this disaster, but I haven't really got any other options left.

My girlfriend bought an iPhone from a seller on eBay.de a month ago. I checked out the buyer before she did and he had good feedback, including a positive response from an iPhone buyer a week before so she went ahead. She paid straight away and he left positive feedback for her, only to vanish off eBay the next day.

She contacted eBay who sent her to PayPal, they said to open a dispute but she felt that he might still send it and gave him a couple of days before opening one. He then had 10 days to respond and on the last day he sent PayPal a tracking number. This morning a package arrived while she was at work so her sister signed for it. Inside the package was two old German comic books (worth €2.50 when they were new).

She rang PayPal and they told her that he was probably going to win the claim as she received a package from him and they can't prove it wasn't a phone. We went to the Gardai who can't do anything because it's a civil matter.

What I want to know is, is there any way we could convince PayPal that he is obviously scamming her. I don't understand how they can look at the facts and favor his version of events.
