Vat on Commercial Leases

    Hi Folks

    Your advice / guidance would be appreciated.

    I took a short lease (4yrs and 9months) which expired last month and I have the option to take out a new lease which i intend to do. I am unable to claim back VAT and i have been paying VAT on the rent at 21.5% and would be grateful if anyone could advise me what my options are in negotiating a new lease. Does the landlord have to charge VAT?

    Hi

    It is at the discression of the landlord whether he charges VAT on the lease or not. Usually it will come down to the fact that he has previously reclaimed VAT on the cost of the building and if he does not charge VAT to the tenent he will have to repay this VAT to the revenue. Checkout revenue.ie re VAT on property for further info.
