Breaking Smart telecom contract

    Due to circumstances beyond our control, we have to move house in the next couple of weeks.

    We would love to keep our contract with Smart, but 1. they can't offer the same service in our new area, and 2. it would take 3 weeks (probably more) or get it set up.

    When we heard this we called NTL - they said that we could be up and running on Monday.

    Smart are insisting that we have to pay out the remainder of our contract (6 months)

    We thought there would be a fee, but 6 months is crazy!
    We tried arguing, but got no where.

    Do we have a leg to stand on? Is there any point in trying to haggle with them? (Their customer service in general is ATROCIOUS by the way.)

    No, it's in your contract, and you're breaking that. They're perfectly entitled to ask for payment in full. You can try and get it cut down, but they don't have to, and you've got nothing to back your argument. You're at their mercy.

    someone here may know or you may want to check with someone more knowledgable on the law but i know wwe were able to renegociate the terms of our contract recently with Smart due to them bring in examinership... this was a business contract and we lowered our annual contract by a large figure

    the same may not apply with a residential contract but its worth a try
