Can I lose my holidays?

    Our company has been downsizing and we have lost many of the benefits and perks we enjoyed in the past. I've also lost an assistant so my work load has increased but not the pay - surprise! Being conscientious I didn't take all my holidays in case I left the company without support. In my contract it states that I have 21 days paid leave/holidays. I've REQUESTED the remainder of my holidays before Christmas or else I'll lose them. Policy - can't carry more than 3 days into the next year. The reply to my request was slow so I asked what's the story and received a laboured reply about pre-Christmas cover.

    Can they refuse to give me the rest of my holidays - legally?

    No , it's not legal.

    They can pick when you take your holidays , but they have to give them to you.

    Thanks jhegarty, that puts my mind at ease. I'm not a holiday person...but next year, if I have a job, I'll certainly apply for them as early as possible.
