    TBH, I only look in here cos I have a brother who moved to Aus about 15 years ago. And cos I'm heading to Perth to see him in...a fortnight now! 6 weeks in the sun sounds good to me.

    Anyway, having read this forum for a while, I'd say there's a good level of advice, help & most importantly realism here.

    I know no-one asked, just thought I'd mention it. :cool:

    The DeFacto / Residency thing sort of overlaps but you can't tick two buttons in the poll. A temp spouse visa gives you temp residency; a perm spouse visa gives you perm residency (with the caveat that when your passport expires you have to have the visa, and therefore one assumes the residency, renewed)

    Will happily heard and tend to llamas somewhere in the andes rather than go back home to Ireland.

    Good question regards 457's I suppose I'll find out next year when me Passport expires, supposed to be a formality to renew, but bear in mind mine was granted under the Howard Government.

    AFAIK they cant just wander in and turf me out of the country wilynily

    since 03, Renewed the 457 in 07 cos Labour 'were sh!tin on about Dem Furrriners tuuk aur Jawbs etc...' in their election campaigns and I knew they didint like AWA's or the rest of it so I figured it'd be safer to just renew slightly early and be sure of it so I'm on me Second 457, Lawyer seems to think I shouild go for Citizenship next.

    yeah thats what I thought meself, your not a PR on a first 457 until you complete it, thats the general deal AFAIR once I kept up my end of the deal the Ausie Govt was obliged to keep their end of the deal and let me stay

    thing is tho, if you ring Immigration and say 'Hey,I'd ike to live in Kunnunurra for a while can I have a Visa?' after they collect themselves from the shock ye sorted, Con is ya live there for 5 years, doing something 'Useful' but being mostlySober counts up there :)

    No, not since 2007 *I think*

    Correct me if wrong, but need 4 years living in oz, at least one of these as a PR
    (4 years excluding any trips away)

    Residence requirement
    People who became permanent residents on or after
    1 July 2007 must have been lawfully resident in Australia for
    4 years immediately before applying including:
    12 months as a permanent resident; and
    • absences from Australia of no more than 12 months,
    including no more than 90 days in the 12 months before
    applying.
    If people became permanent residents before 1 July 2007 and
    apply before 30 June 2010, they must have been physically
    present in Australia as a permanent resident for a total of
    2 years in the 5 years before applying
    , including 1 year in the
    2 years before applying.

    You cant go from a 457 to Citizen because it is only a temporary visa you would have to jump through the PR hoop for at least a year to get citizenship.

    yes they can just make you leave, on the epiry of your current 457 or else if you commit a serious enough crime, its also easy to renew but you have now residency rights. i've looked thru some of the info you've posted and most of it is incorrect, you should speak with someone to fully understand the visa your on and the restrictions it has

    also you have no entitlement to citizenship under the new rules you will only need one year as your time as a temp resident (457 will count) but you need a mimimum of 12 months with not more than 3 momnths of that 12 outside of australia as a pr .You have NOT got PR irrespective of how long or how many 457 visas you have had

    no of posts is irrelevent doesnt mean by knoweldege of the australian immigration system is any less valid than someone with 10,000 posts on a whole load of topics.

    2003 live in brisbane since then, became a citizen last january.

    there a number of people on this forum telling you, your incorrect i am a 110% certain the 457 visa is not a PR visa, it is however a good stepping stone if you go down the ENS route and will make PR through your employer a formality.

    i've been throught full process, eta-417-2x457-175-citizenship plus adding a defactot to the 457 and 175. i'm not saying it to rain on your parade i'm only highlighting it so you can sort it out.

    if you believe i'm incorrect please refer me to a link on the www.immi.gov.au site that says otherwise, or even a link on a speclised immigration forum such as brisbane expats.

    it will be easy to get the ENS sorted for you, but dont leaave it the way it is if you want PR as you dont have it now.

    mahatma coat You should consider getting a new lawyer.

    I'm not a MARA registered migration agent but having been through 457 and PR myself I know that to be a Permanent resident you have to apply for a PR type visa. Its not hard to find the information on the www.immi.gov.au web site.

    PR is gonna set you back $7k all in inc your lawyer fees if you dont use a lawyer it will still cost about $3K but to be honest if you dont know the difference between PR and TR I would get a professional to do it.

    Jaysus theres me labourin under the pretense that the First 457 was enough to Qualify me as a PR, So I Just Rang Eugene, Apparently you are right, Bugger, well good that its clarified this side of the expiry date on my 457, I should really pay more attention to these sorts of things.


    So today we learned that Mahatma dosent listen when people tell him important things about his livin in Australia, but ya all know that theres feck all chance of me doing anything about the situation till a week before my Passport expires.

    Just checked, Passport expires first, then Visa a year and a bit later.


    whats that old joke
    The fact that I couldnt be arsed fillin out the forms should Automatically qualify me to be an Australian:D:D:D

    i only brought it up so you knew the story, you can be here forever on a 457 once its kept being renewed but at no point will it automatically turn into a PR visa just because of time spent. if you go down the 175 visa it may take you till 2012, the quickest way for you would be the ENS you'll have to talk to your employer but shouldnt be a problem seeing as they have sponsored you for so long.

    get it sorted tho asap because if you loose your job for whatever reason you have 28 days to leave australia or to find another sponsor, you also need PR for buying houses (2nd hand houses that is) you can buy new, or you can buy 2nd hand but you HAVE to sell when you leave Australia on the expiry/cancellation of your 457, new house you can keep. car loans etc if they check will only be given over the lent of the remaining time on your visa, your bank problem wont check as you have been banking with them so long.

    obviously Brisbane is now your home so get it sorted asap, ENS should be painless and quick.
