Cycling while drunk?

    First of all, I did search but didn't find any past threads. It's probably been discussed at some stage but I didn't find it.

    If I'm a poor student and spent all my money on beer and now can't afford a taxi, what law can a garda stop me for and what are the penalties?

    Or another example if I'm having drinks with friends in the apartment and need more drinks but don't own a car so I grab a backpack and cycle to the off-licence.

    It's something that hundreds of thousands in Ireland have done at some stage.

    What are the consequences?

    As an anecdote, I had a friend who was completely smashed (they admitted they were so drunk that they couldn't stay in the right lane) while cycling, let off by Gardaí.

    It's possible he didn't know that he could arrest her, because even she would admit that she was a danger.

    The test is a subjective one as to whether said student is drunk - breathalysing doesn't apply.

    I have been stopped for drunk cycling a number of times.

    Generally in circumstances where I have been a danger to myself.

    You will be advised to get off the bike and if you are a danger to yourself the bicycle may be confiscated. Unless you are obnoxious you will not be arrested.
