Garda Adult Caution

    Hello all,

A few months ago I was involved in a street fight. I wont go into the details but to cut a long story short it was a drunken row that got out of hand (and I should note that I have since given up drinking as a result of this incident) but I was taken in and given an 'adult caution' the next day in the local Garda station. I had never been in trouble with the law before, nor have I been in trouble since. What I would like to know is:

    1. Do 'adult cautions' stay on record permanently, or do they expire after a certain amount of time?

    2. Would the 'adult caution' prevent me from possible future employment in the public sector?

    3. Would the 'adult caution' affect me if I wished to emigrate?

Thanks, and I look forward to any feedback that any of you may have.

    Rod

You would only have been given the adult caution if you accepted it. In answer to your questions, Permanent, highly unlikely, highly unlikely.

Basically, a record is maintained on the Garda Pulse system that you have accepted an adult caution. It is most certainly not a convicton. It will not be disclosed on a check for criminal convictions as I currently understand the position. You'll note that currently job and visa apps will ask the question 'have you ever been convicted of an offence' or 'have you ever been prosecuted in court for an offence'. In your case the answer is, truthfully, no.

    Thanks Reloc8,
That's most helpful. The thing is, I hope to apply for the prison service in the future and was wondering would it hold me back. I did accept the caution as I was caught red handed by a Garda while I was fighting and would not have had a leg to stand on had I tried to fight it in court. So I cooperated fully and signed the caution. Thanks again.
